1. Agreement to these Terms

By accessing https://allmarinemotors.com/ (the “Site”), requesting a quote, creating an account, or placing an order with All Marine Motors Inc. (“All Marine,” “we,” “us,” or “our”), you agree to these Terms and Conditions (“Terms”) and to our Privacy Policy.

If you do not agree, do not use the Site or place an order.

3. Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law to place an order. Sales are available to both consumers and businesses. If you order on behalf of a business, you represent that you are authorized to bind that business.

4. Products, specifications, and descriptions

We sell marine engines, drives, parts, and related products. Product pages may show manufacturer specifications, images, and compatibility notes.

Important:

• Manufacturer (OEM) specifications, model years, configurations, and availability can change.
• Where an OEM published specification differs from Site text, the OEM documentation for the exact model/configuration prevails.
• Images are illustrative and may show options, finishes, or accessories not included.
• Prices, stock status, and lead times shown on the Site may change without notice until an order is accepted by us in writing or by fulfilling the order under the process you approve.
• We do not invent inventory. Products marked unavailable, special-order, or “contact for stock” require confirmation before purchase.

Third-party trademarks (including Mercury®, Mercury Racing®, Yamaha®, Honda®, Suzuki®, Tohatsu®, Volvo Penta®, Cummins®, and others) belong to their respective owners. Use on the Site is for identification of compatible or offered products and does not imply that All Marine is an authorized dealer for every brand unless we expressly state an authorization that is true.

5. Quotes, orders, and acceptance

• A product page, cart, or quote request is an invitation to treat / request, not automatically a binding sale.
• We may accept, decline, or cancel an order (for example, for pricing error, stock error, suspected fraud, export restrictions, or inability to ship to your location).
• High-value or special-order engines (including certain Mercury Racing and similar products) may require a deposit, written confirmation of configuration, and longer lead times. Deposit terms are case-by-case — contact us for the terms that apply to your order.

6. Pricing, taxes, and currency

• Prices are as displayed at checkout or as stated in a written quote we issue, in USD unless a written quote states another currency.
• Taxes may apply based on destination and local law and may appear at checkout where configured.
• For international orders, the customer is responsible for import duties, VAT/GST, brokerage, and customs clearance unless a written quote from All Marine says otherwise. Any bank or FX fees charged by your payment provider are your responsibility.

7. Payment

Payment methods accepted at checkout or by invoice will be those we enable on the Site or confirm in writing. We do not claim to store customer bank card numbers on our own systems; payment processors handle card data under their terms. Orders may be held until funds clear when we use wire, check, or similar methods.

8. Shipping, risk of loss, and title

Shipping is described in our Shipping Policy. Delivery timing depends on product, stock, destination, and carrier. For freight / oversized engines, additional arrangements (liftgate, appointment, crane, dock delivery) may be required.

Unless a written quote states otherwise, risk of loss passes when the shipment is handed to the carrier. Failed delivery, storage, redelivery, and address-error costs may be charged to the customer when caused by incorrect information or refusal of delivery.

9. Returns, refunds, and cancellations

Returns and refunds are governed by our Returns and Refunds Policy. Cancellations after processing may not be possible for special-order or in-transit items.

10. Warranties

• Manufacturer warranties: Many products may include a manufacturer’s limited warranty. Warranty terms, duration, and registration requirements are set by the OEM, not invented by All Marine.
• All Marine’s own warranty: Unless required by law or expressly stated in writing, All Marine provides OEM pass-through warranty assistance only and does not offer a separate store warranty.

Except as required by law or expressly stated in writing, products are otherwise provided without additional warranties.

11. Prohibited uses

You may not use the Site to:

• violate law or export / sanctions rules;
• scrape, attack, or overload the Site;
• submit false identity or payment information;
• infringe intellectual property rights;
• resell content scraped from the Site without permission.

12. Intellectual property and trademarks

Site content (text, layout, original photos we own, logos we own) is protected by applicable IP laws. Third-party trademarks belong to their respective owners and are used for product identification.

13. Limitation of liability

To the maximum extent permitted by applicable law, All Marine’s total liability arising out of or related to any product or order is limited to the amount you paid to All Marine for that product. All Marine is not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, downtime, or haul-out costs) where such limitation is allowed by law.

Nothing in these Terms is intended to exclude liability that cannot be excluded under applicable law (including certain consumer rights where they apply).

14. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Venue for disputes that proceed in court is in the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise.

15. Changes

We may update these Terms by posting a revised version on the Site. Material changes affecting existing accepted orders will be handled as required by law and any written order terms.
